Terms of FantaGamesHub

Draft awaiting review by a licensed lawyer. Version 0.1.

Part A — Website Terms of Use, in effect today

These terms apply to anyone visiting the FantaGamesHub site as it exists today: a presentation page, with no registration, no account, and no active game features.

A.1 What the site is, today

FantaGamesHub, today, is an informational site presenting a product under construction: a catalogue of games designed to be organized among friends, colleagues, or family around real-life occasions. You cannot create an account, you cannot play, you cannot buy anything: the site describes what the product will do, it doesn't do it yet.

A.2 Ownership of content

The text, game names, design, logos, and any other content published on this site belong to Federico Calò or are used with proper authorization, and are protected under applicable copyright and intellectual property law. You may browse, read, and share a link to these pages freely; you may not copy, republish, or commercially reuse the content without written permission.

A.3 No warranty

The site, in its current phase, is provided «as is». We do our best to keep it accurate and available, but we don't guarantee it will always be error-free, always reachable, or always up to date with the real state of product development in real time.

A.4 Limitation of liability

To the extent permitted by applicable law, FantaGamesHub and Federico Calò are not liable for indirect damages arising from the use of, or inability to use, the site in its current presentation phase. Nothing in this clause limits liability that cannot be excluded by law.

A.5 Links to third-party sites

The site may contain links to third-party sites (for example, the developer's personal website). We are not responsible for the content or practices of these external sites.

A.6 Governing law and jurisdiction

These terms are governed by Italian law. For disputes with users who qualify as consumers, the jurisdictional rules established for their protection apply (typically, the court of the consumer's place of residence or domicile). [Specific venue or further detail to be confirmed with a lawyer.]

A.7 Changes to these terms

We may update these website terms of use at any time, noting the new update date at the bottom of the document. Significant changes will be flagged visibly on the site.

Part B — Product Terms of Service, in effect once the features are live

This part describes contractual obligations for features that don't exist yet: no acceptance is required until the corresponding feature is actually available. Once registration is live, this part will become the actual Terms accepted at account creation.

B.1 Purpose

These terms will govern the use of FantaGamesHub once it becomes possible to create an account, form groups (Crews), organize matches (Games) with one or more leaderboards (Leagues), and — for those who choose to use them — purchase Credits and take part in friendly bets. By creating an account, you will accept these terms together with the privacy policy, the cookie notice, the community guidelines, and, if and when you use Credits, the specific conditions described in B.7.

B.2 Who will be able to create an account

  • You will be able to create an account starting at age 14. Below that age, the account will only be creatable with the consent of a parent or legal guardian.
  • You will be able to use Credits and take part in friendly bets only starting at age 18. Accessing these features will require a declaration that you meet the required age.

B.3 Your account

You will be responsible for keeping your login credentials confidential and for any activity carried out through your account. If you suspect unauthorized access, you must notify us immediately.

B.4 Content you write

Some parts of the product will let you write free text: a note explaining why you awarded points, an anonymous message, a wish list. You will be solely responsible for what you write. In particular, you will agree to:

  • not include personal data about other people that isn't necessary for the purpose of the game, and in particular never include information about anyone's health, ethnic origin, political or religious opinions, or sexual orientation — yours or anyone else's — in these fields;
  • not use harassing, discriminatory, defamatory, threatening, or sexually explicit language;
  • not impersonate real people, and not use third-party registered trademarks in the name of a group or match in a way that could suggest official endorsement.

We may remove or hide content that violates these terms, and in serious cases we may do so without prior notice.

B.5 Community rules

Mutual respect among users will be governed in detail by the community guidelines, incorporated here by reference and binding in all respects as part of these terms.

B.6 Credits: what they are and what they are not

This section will apply once purchasing Credits becomes available.

  • Credits will be a virtual unit purchasable with real money, through our payment provider (Stripe), to use inside FantaGamesHub to unlock advanced features, customization, increase certain limits, and — for those 18 or older — take part in friendly bets.
  • Credits will not be money. They will not be a currency, will not represent a store of value, will not earn interest, cannot be converted into real money, cannot be withdrawn, and cannot be transferred to third parties outside the platform's betting mechanism. Their value will exist exclusively within FantaGamesHub.
  • Any attempt to get around this restriction — for example, arranging with another user to exchange Credits for money outside the platform — will be a violation of these terms and may result in account suspension.
  • Credits you purchase will not be refundable once credited, except as required by applicable withdrawal-right law and by the specific purchase conditions.

B.7 Purchases, withdrawal rights, and bets: specific conditions

Detailed conditions on pricing, payment method, the right of withdrawal, and the rules of friendly bets will be described in a dedicated document, shown before every purchase and before first accessing bets, which will require acceptance separate from these general terms. That document has not been written yet: it must be produced alongside the launch of payments, paying particular attention to withdrawal-right rules for digital content.

B.8 Suspension and closure of your account

We may suspend or close your account if:

  • you violate these terms or the community guidelines;
  • we, in good faith, suspect abuse of the Credits or betting features (for example, an attempt to bypass age or wager limits);
  • we are required to by a legal obligation.

During a suspension, Credits in your wallet will remain recorded and will not be deleted; access to the product's features will stay blocked until the suspension is lifted or the account is permanently closed. You can request a review of a suspension by writing to the complaints channel described in B.11. You can close your account at any time from your profile or by writing to us: closing it does not entitle you to a refund of unused Credits, except as required by law.

B.9 Limitation of liability

To the extent permitted by applicable law:

  • we do not guarantee the product will always be error-free or always available;
  • we are not responsible for content other users write, subject to our commitment to remove it when it violates these terms once we become aware of it;
  • for friendly bets, we are not a party to the bet: we provide the technical tool that governs the deposit and release of Credits based on the declared outcome, according to the game's rules; any disputes between the parties about the actual outcome of the event being bet on are handled through the complaints procedure in B.11.

B.10 Governing law and jurisdiction

These terms will be governed by Italian law. Users who qualify as consumers retain the protections set out under the law of their country of residence, including rules on jurisdiction. It must be confirmed with a lawyer whether a separate governing-law or dispute-resolution clause is advisable for U.S. users.

B.11 Complaints and communications

For any complaint, in particular one relating to a purchase, a Credit, or the outcome of a bet, you will be able to write to: [dedicated email to be added]. We will respond within the timeframes described on the dedicated complaints page.

B.12 Changes to these terms

Substantial changes (ones that significantly affect your rights or obligations) will require a new explicit acceptance the next time you log in after publication. Minor editorial changes are still tracked with a new date at the bottom of the document.
